Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") are a legal agreement between you and CareCam.io ("CareCam," "we," "us," or "our") governing access to and use of our website at https://carecam.io and our software, services, and related offerings that link to or reference these Terms (collectively, the "Services"). By using the Services, you agree to these Terms and to our Privacy Policy.

If you are using the Services on behalf of a daycare, preschool, or other organization ("Center"), you represent that you have authority to bind that organization, and "you" includes both you and the Center.

2. Definitions

  • Center: A childcare provider or school account that configures cameras, access rules, and parent permissions.
  • Parent User: A parent, guardian, or other person the Center authorizes to access live (or, where available, recorded) viewing through the Services.
  • Services: Our cloud platform, local gateway software or appliances where applicable, support, documentation, and related features we make available, as described in your order, plan, or published materials.

Supplemental terms. If you sign a separate order form, statement of work, or enterprise agreement with CareCam ("Order"), those terms apply to the scope they describe. If a conflict exists between an Order and these Terms for that scope, the Order controls.

3. The Services

CareCam provides tools to help Centers stream compatible camera feeds to authorized Parent Users with access controls, classroom-level permissions, and viewing schedules. Features may include a local gateway to send encoded streams to CareCam's systems for delivery to parents. The Services are not a replacement for in-person supervision, licensing compliance, or emergency response systems. Cameras, networking, and on-site equipment remain your and your vendors' responsibility except as expressly included in a written professional services statement.

We may change, improve, or discontinue features with reasonable notice when practicable. We are not required to support every camera model, network, or environment.

4. Eligibility and accounts

You must be at least eighteen (18) years old, or the age of majority in your jurisdiction, to enter into these Terms. Parent Users under 18 may only use the Services with a parent or guardian who accepts these Terms and our Privacy Policy on their behalf.

You are responsible for the accuracy of registration information, safeguarding passwords and devices, and all activity on your account. Notify us promptly at carecam@carecam.io of any unauthorized use.

5. Center responsibilities

Centers are solely responsible for:

  • Compliance with applicable childcare, privacy, and safety laws, including any required consents, signage, and policies for video in classrooms and common areas;
  • Provisioning, reviewing, and revoking Parent User access, including classroom permissions and viewing windows;
  • The content of any stream (including the presence of children and staff) and the suitability of camera placement; and
  • Physical security, camera hardware, wiring, and network—unless a separate services contract with CareCam says otherwise.

Relationship. CareCam provides the Services as a technology provider. We do not employ your staff, supervise children, or control day-to-day Center operations.

6. Parent and user conduct

Parent Users agree to:

  • Use the Services only in accordance with the Center's rules and only during permitted times;
  • Not share login credentials, circumvent access controls, or attempt to view streams or data they are not authorized to see;
  • Not use streams to harass, record, or exploit staff or children, or to violate any law;
  • Not attempt to copy, download, or redistribute live streams in ways that harm privacy or violate the Center's policies. Depending on your app version and platform, additional technical restrictions may apply.

The Center—not CareCam—sets behavior rules for families. We may suspend or disable accounts that appear to endanger safety or breach these Terms.

7. Live viewing, recording, and features

Unless your Order or in-product documentation explicitly says otherwise, the Services are generally oriented toward secure live parent viewing and access controls. Cloud recording, long-term storage, and advanced analytics are not guaranteed in any particular plan. If recording is not part of the plan you purchase, you should not treat recording as included. Ask CareCam in writing for any recording or retention option you need for compliance.

8. Third-party services and equipment

The Services may depend on third-party networks, internet providers, app stores, payment processors, and camera manufacturers. Your use of those third parties may be subject to their own terms. CareCam is not responsible for third-party products, outages, or data practices except as required by law.

9. Fees, taxes, and payment

You agree to pay the fees in your selected plan, Order, or checkout flow. Published monthly plans on our website are generally month-to-month unless we state otherwise at purchase.Camera hardware, wiring, and installation are typically separate from software fees unless a written statement includes them. Taxes, if applicable, are your responsibility unless we are required to collect them.

We may use third-party payment processors. By providing payment information, you authorize us and our processor to charge the payment method for amounts due. Late or failed payments may result in suspension of the Services.

10. Intellectual property

CareCam and its licensors own the Services, including software, branding, and documentation. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services in accordance with these Terms. You may not reverse engineer (except where prohibited by law), resell, or build a competing product from our Services. Feedback you provide may be used by CareCam without obligation to you.

11. Privacy

Our collection and use of personal information is described in our Privacy Policy.

12. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. VIDEO STREAMS MAY BE DELAYED, INTERRUPTED, OR UNAVAILABLE.

Some jurisdictions do not allow certain warranty exclusions; in those jurisdictions, our warranties are limited to the fullest extent permitted by law.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARECAM AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS.

Our aggregate liability for any claim arising out of or relating to the Services or these Terms will not exceed the greater of (a) the fees you paid to CareCam for the Services in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100), except where applicable law does not allow such a cap.

14. Indemnity

You will defend, indemnify, and hold harmless CareCam and our officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of a third party's rights; or (d) content or activities at your Center, including any claim related to child privacy, employment, or negligence—except to the extent caused by CareCam's willful misconduct.

15. Term; suspension; termination

We may suspend or terminate access to the Services for breach of these Terms, non-payment, legal risk, or as required by law. You may stop using the Services at any time. Provisions that by their nature should survive (including limitations of liability, indemnity, and governing law) will survive.

16. Governing law; venue

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, except where the laws of your country or state require otherwise regarding consumers. Subject to applicable law, the state and federal courts located in Delaware, USA will have exclusive jurisdiction over disputes, unless you and CareCam agree otherwise in writing. You and CareCam consent to personal jurisdiction in those courts.

17. General

  • Changes: We may update these Terms by posting a new version and updating the "Last updated" date. Material changes will be posted with reasonable notice when practicable. Continued use after the effective date may constitute acceptance.
  • Entire agreement: These Terms, the Privacy Policy, and any Order form the agreement between you and CareCam regarding the Services.
  • Assignment: You may not assign these Terms without our consent. We may assign in connection with a merger, sale, or reorganization.
  • Export: You will comply with export and sanctions laws.
  • Severability; waiver: If a provision is unenforceable, the remainder remains in effect. Failure to enforce is not a waiver.
